Articles 118 & 119

Article 118 of the Uniform Code of Military Justice defines the offense of murder. Murder is charged when it is believed the accused acted with intention when the death occurred. There are various circumstances where this definition applies.

Murder can be charged when it is believed the defendant:

  • Premeditated (or planned) on killing another individual
  • Intentionally meant to inflict great bodily harm to another individual
  • Killed another individual in the course of committing another crime
  • Killed another individual while performing a reckless, dangerous act

Article 119 of the Uniform Code of Military Justice describes manslaughter. While considered less severe than murder, it is still a serious allegation. In these cases, it is believed that the accused caused the death of another individual without intending to do so.
